Guelph-Eramosa appoints lawyer for OMB appeal

Guelph-Eramosa council has appointed Aird and Berlis LLP to represent the township in an Ontario Municipal Board (OMB) appeal.

Hasan Hasan, who lives adjacent to the proposed Tri City Lands Ltd. “Spencer Pit” in the southwest corner of the municipality, has appealed the township’s rezoning of the property.

A group of residents has also filed an objection with the OMB over the Tri City Lands licence application with the Ministry of Natural Resources and Forestry.

The company originally applied for a zoning bylaw amendment and a licence under the Aggregate Resources Act in March 2014.

The proposed pit is on Wellington Road 124, north of an existing rail line, opposite Kossuth Road.

The rezoning application requested that 51 hectares (127 acres) of land zoned agricultural be rezoned to extractive industrial, allowing for above-the-water-table extraction of up to 650,000 tonnes of aggregate annually for five to 10 years. Guelph-Eramosa passed the zoning bylaw amendment on May 2.

According to the OMB site, two days have been set aside for a hearing, starting on Jan. 18 at 10am at the Guelph-Eramosa municipal office in Brucedale.
