Councillors here are extending their agreement with Curve Rock Condominiums in Mount Forest for another five years.
Prior to the discussion, Mayor Mike Broomhead declared a conflict of interest. He owns a home in the development on Birmingham Street.
Slower than expected sales have meant the project has not proceeded as planned. A letter to the municipality from Kevin Drier stated the condominium corporation was formed in June 2006 and is a phased condo development.
The initial phase included a 10-unit townhouse complex with phase one being a 24-unit apartment condo complex, and phase two being another 24-unit apartment condo complex.
Phase two has yet to start.
While the initial townhouse complex was completed and sold out in December 2006 and transferred to the condo corporation, due to market conditions developers were unable to sell the 24-unit apartment condo units and were unable to transfer that phase one portion into the condo corporation.
There is a five-year deadline to meet the conditions of approval issued by Wellington County for the condo corporation.
The Condominium Act permits a delay for up to 10 years the initial registration, which was June, 30, 2006. The conditions of approval issued by the county expire five years after the date of their issuance, unless an extension is sought and granted.
Drier has contacted the county concerning the five-year extension in the registration of phase one and phase two and was told Wellington North must first pass a resolution that council has no objection to a five year extension for phase one and phase two.
He asked council to pass a resolution stating the Wellington North does not object to the extension of the registration.
Discussion at council was chaired by councillor Ross Chaulk, who asked if there were any objections at council.
There were none. The resolution supporting the extension was passed.
