Council awaiting next step in Swastika Trail judicial review

Puslinch council is awaiting the next step in the Swastika Trail judicial review before taking any further action.

Following an in-camera discussion on April 18 Puslinch Mayor Dennis Lever stated, “An application for judicial review has been filed and served on the township.

“The applicant is required to perfect the application and as a result the township is taking no further action at this time.”

CAO Karen Landry said the rules of civil procedure require that the applicant shall deliver an application record together with a “certificate of perfection.”

“That is the next step in the process,” she said.

On April 9, Randy Guzar and William Knetsch launched a judicial review of the township’s decision to retain the name of the private road near Puslinch Lake in the southwest corner of the township.

They allege the Dec. 20 decision of council was based on the results of an unfair and biased process that led to a 25-20 vote by the Bayview Cottagers Association to retain the name Swastika Trail.

A certificate of perfection involves the lawyer for the applicant certifying that all required material has been filed, including the names, addresses and telephone numbers for all parties involved.
