Bylaw allows St. Andrew Street property access to unopened road allowance

ELORA – Council has repealed and replaced a bylaw regarding an unopened road allowance adjacent to 525 St. Andrew St. East in Fergus.

The house was built close to the road allowance so with the reconstruction of St. Andrew Street and the addition of a bike lane and sidewalk, the homeowners lost their driveway on the municipal boulevard.

There is no other vehicular access point on the property.

“So we fortunately have an unopened road allowance right beside their property and so we were able to construct a new kind of driveway or parking area for them right beside their home and they were quite pleased with that,” said managing director of infrastructure services Colin Baker at the Nov. 25 council meeting. “So it worked out very well.”

While the municipal access agreement was authorized in May 2018, at the Nov. 25 meeting council repealed and replaced a bylaw from 2016 that was applicable to that road allowance.

“We did a similar situation just up the hill off of St. Patrick Street for another development, providing driveway access and so we were advised that the existing bylaw just needs to be repealed and replaced,” Baker said.

The bylaw now provides 525 St. Andrew St. East access to the unopened road allowance as well.
