It seemed almost anti-climactic.
With passage of Bylaw 73-08, Wellington North council has authorized the sale of the South Luther Hall.
That event, marked what should be a quiet end to controversy that has dogged council for the past number of years.
Council had finally reached an agreement to sell the hall to Friends of the South Luther School, only to discover that not all the signataries of the original agreement were ready or willing to sign off.
The agreement stated the lands would be used only for municipal recreation purposes.
What is believed to be the final hurdle was a decision on Aug. 5 at the Superior Court of Justice in Guelph, regarding the covenant on the property that required that the building be demolished and removed if it were no longer to be used by the municipality.
The decision of the court was that the covenant “is void and unenforceable at law and has no legal effect on the Corporation of the Township of Wellington North.”
Now, Wellington North is authorized to agree to an offer to purchase by the Friends of the South Luther School for the property at Part Lot 18, Concession 2 in the former township of West Luther for $1.
