Bylaw allows creation of lots on two properties

Part lot control exemptions will affect two nearby properties in Fergus.

On Aug. 13, Centre Wellington council authorized the mayor and clerk to execute a bylaw to exempt Lot 8 and Lot 37 of Registered Plan 104, in Fergus, and Lot 25 of Registered Plan 117, in Fergus, from the part lot control provisions of the Planning Act.

The bylaw will be submitted to the County of Wellington for approval.

Planning director Brett Salmon explained this exemption involves two separate properties in the former town of Fergus.

He noted one block is between Perry and Woodside street where one house was already constructed and an easement granted to the municipality.

Salmon pointed out the township had previously passed a part lot control exemption bylaw.

But such bylaws usually have an expiry date.

In this case, it had expired, and the lot to be created was never conveyed, Salmon said.

He added the same owner made application for a single detached home to front onto Woodside.

Lots 8 and 37 of Plan 104 are on St. David Street North and Woodside Street in Fergus.

A single detached dwelling presently exists on Lot 37. Lot 8 fronts onto St. David Street North and it is proposed that a semi-detached dwelling be constructed on Lot 8.

It is zoned appropriately for this use. The owner has recently entered into a site plan agreement for Lot 8.

Lot 25 of Plan 117 is the subject of a previous development agreement with the township.

A site plan agreement that provides for two single detached dwellings to be constructed, one facing Woodside Street and one facing Perry Street, was entered into in 2006.

This agreement required the owner to pay for the installation of a storm sewer on behalf of the township, and an easement for this storm sewer has been granted to the township.

A part lot control exemption by-law to facilitate the division of the property into two lots was passed in 2008, but the separation of the property into two separate owners did not take place before the bylaw expired in April of 2010.

Therefore, the proposed bylaw also reinstates the part lot control exemption for Lot 25.

Council endorsed the bylaw, which will be submitted to Wellington County for approval.
