What are Canada’s obligations under the United Nations agreements?
What would Mr. Viroj Sumyai, President of the International Narcotics Control Board (INCB) or Mr. Zeid Ra’ad Al Hussein, High Commissioner for Human Rights have to say about Bill C-45 the Cannabis Act which legalizes the recreational use, sharing, production, and distribution of cannabis (marijuana) in Canada?
How soon after legalization will the General Assembly of the UN intervene? What sanctions will the UN impose on Canada?
Why are competent health professionals and Canadians who work with at-risk communities such as aboriginals and youth being ignored? Could this be only about taxing the sale of cannabis and realizing monetary benefits?
What are Canada’s obligations as a signatory to the United Nations Conventions on Narcotic Drugs (1961, 1971, and 1988)?
Does Canada have a duty to the international community to uphold all of the resolutions adopted under these Conventions? Article 3 of the 1988 Convention reads: “Each Party shall adopt such measures as may be necessary to establish as criminal offences under its domestic law, when committed intentionally: The production, manufacture, extraction, preparation, offering, offering for sale, distribution, sale…of any narcotic drug or any psychotropic substance…”
Will Canada’s legalization of recreational cannabis undermine international order and the enforcement of narcotics laws in other countries? If Canada violates the Convention on the Rights of the Child, and does not protect children from the illicit use of psychotropic substances, what legal measures will Canada suffer on the international scene? Are political interests being elevated over the health and welfare of its citizens?
